Victory in Virginia – Winning One for Limited Government

Dateline: Virginia, December 14, 2010

Ken Cuchinelli, the attorney general of the state of Virginia, prevailed in Federal District Court yesterday, for the people of Virginia , and for all Americans, when he won a 1st round victory against Obama Care’s government mandates that require every American to purchase a health insurance policy or else pay a fine. That’s really winning one for the people, and for limited government! The Department of Justice argued that the fine really wasn’t a penalty for non-compliance, but rather it was a tax, and because Congress has the power to tax, it was all perfectly legal. However, Judge Henry Hudson did not buy that argument, and found in favor of the plaintiffs, the State and people of Virginia. Next stop, the Court of Appeals, but for now the score is:

Analysis: Judge Hudson was appointed by a Republican President. Two other cases challenging the constitutionality of Obama Care have come up before Democratic appointed judges and have been denied, so it looks like this is going to be a long drawn out battle, working its way all the way up to the Supreme Court. That is why it is absolutely essential that we defeat Obama in 2012 with a strong conservative candidate, and we must hold on to the White House for the foreseeable future so that no more Liberal-Progressives are appointed to the Supreme Court! This is where the constitutionality of Obama Care will ultimately be decided. Meanwhile, another case challenging Obama Care which was jointly filed in Florida District Court by 21 states is simultaneously working its way up through the legal system.
